Rental terms

English translation for your convenience. The legally binding version is the German one — see the AGB (§12).

§1 Scope

These terms govern the rental of the DJI Mini 5 Pro Fly More Combo drone by Anna Radová (Dronie Munich) (the “Lessor”) to consumers and businesses (the “Lessee”).

§2 Formation & confirmation

The rental contract is formed on successful payment through the website. The booking is confirmed immediately; no separate approval by the Lessor is required, because only genuinely free dates are bookable.

Withdrawal for good cause. The Lessor may withdraw from the contract or decline to hand the drone over where there is a substantively justified reason — in particular where (a) the photo ID presented is not in the name of the booking, (b) the Lessee is plainly not in a condition to operate the drone safely at handover, for example under the influence of alcohol or drugs, (c) the Lessee cannot show they are 18 or over, or (d) the item is not serviceable because of damage from an earlier rental. In those cases the rental price is refunded in full and the §4 reservation released; further claims for planning or consequential loss are excluded.

§3 Price & payment

The prices shown on the website apply: €89 first day, €55 each additional day, €399 per week. The rental price is due immediately on booking. No VAT is charged under § 19 UStG (small-business rule).

§4 Card reservation

An amount of €400 is set aside on the Lessee's card, not charged. The Lessor releases the reservation immediately after proper return — usually the same day. How long it then takes to disappear from the Lessee's account is up to their bank and can be a few working days; the Lessor has no influence on that. The Lessor may draw on it in whole or in part in the event of damage, loss or theft of the item, late return under §8, or missing or damaged accessories — in each case up to the documented amounts set out in §7. Further claims for damages remain unaffected.

§5 Handover & return

Handover and return take place in person in München. The Lessee presents a valid government photo ID at handover. The condition of the item is inspected together at handover and return. The Lessor may record that condition in time-stamped photographs; the Lessee receives a copy on request.

§6 Lessee's authorisation to operate

The Lessee is 18 or over and confirms on booking that they are permitted to operate the drone and meet whatever legal requirements apply to doing so. The Lessee complies with all applicable air-traffic, flight-restriction, geo-zone, data-protection and nature-conservation rules.

§7 Insurance & liability

The Lessor carries commercial UAS operator liability insurance with €10m cover (€150 excess). Only lawful flightsare insured. The Lessee is co-insured as an authorised user for as long as they operate the item with the Lessor's knowledge and consent and within the applicable rules.

In the event of damage, the Lessee pays:

  • Accidental damage (crash, water): €75 DJI Care replacement fee plus shipping
  • Flyaway or loss of the aircraft: €319 DJI Care flyaway fee plus shipping
  • Third-party property damage: €150 (the insurance excess)
  • Theft, loss or non-return of the complete kit: replacement value €909 (the drone together with the equipment supplied)
  • Individual missing or damaged parts (controller, battery, charger, filters, case, propellers): at the documented replacement cost of the part, capped in total at €909
  • Downtime while the item is being repaired: €55/day, capped at 3 days (€165)

No double counting: downtime is charged only for days the item is actually under repair. Where there is a flyaway, a theft or a total loss it does not apply, because replacement takes the place of repair.

The Lessee's obligations: fly with the DJI account linked and flight records enabled, and keep those records intact. Report any incident without delay, make the flight records available, and return every damaged component. Where the Lessee breaches these obligations and an insurance or warranty benefit is lost as a result, the Lessee is liable for the full replacement value.

Exception for unlawful use: the caps above apply only to lawful, accidental damage. In the event of deliberate or unlawful operation — in particular flying under the influence of alcohol or drugs, in restricted zones without permission, or in disregard of the operating rules — insurance cover falls away entirely. The Lessee is then liable for the full replacement value together with all fines and proceedings costs.

Airspace and fines: before every flight the Lessee checks the applicable airspace restrictions via the official services (DIPUL or Droniq). The Lessee is solely responsible for complying with all air-traffic, data-protection and nature-conservation rules, and indemnifies the Lessor against every official fine, proceedings cost and court cost arising from their operation.

Availability: if the item becomes unusable through damage, the Lessor may cancel the confirmed bookings affected. Those Lessees are refunded in full; further claims for planning or consequential loss are excluded. The rental days lost that way are exactly the downtime the Lessee who caused the damage bears under the list above — they are not charged twice.

No flat penalties are charged — only documented actual cost. The card reservation under §4 is drawn on up to the documented amount and the rest freed; where the damage exceeds the reservation, the Lessor invoices the documented difference. The Lessee reports damage without delay; a late report can void DJI cover and is then at the Lessee's expense.

Proof of lower loss. In every case where these terms set a flat amount — including §8 and §10 — the Lessee remains free to show that no loss, or a substantially smaller one, was actually incurred. Where that is shown, only the smaller amount is owed.

§8 Late return

Notified in advance. Where a delay becomes apparent, the Lessee tells the Lessor before the agreed return time. If the calendar allows it, the rental is simply extended: only the regular additional-day price of €55 for each day started is charged. A notified delay of up to an hour costs nothing.

Not notified. Where the return is late without prior notice, the regular daily rate is charged for each day started and drawn from the §4 reservation. If the drone was booked for someone else, the Lessee also bears the resulting downtime under §7. If the item is not returned despite a request and a deadline, it counts as non-return under §7.

Proof of lower loss under §7 remains open to the Lessee in both cases.

§9 Sub-letting

Sub-letting or passing the item to third parties is not permitted without the Lessor's prior written consent.

§10 Cancellation

  • Up to 48h before pickup: free cancellation, full refund, the §4 reservation freed.
  • Less than 48h before pickup: the first rental day is charged, the rest refunded.
  • No-show without notice: the full rental is retained, the §4 reservation still freed.
  • Cancellation by the Lessor: full refund and release of the reservation, whenever it happens.

The retained first rental day is a flat rate too: you may show that the Lessor suffered no loss or a substantially smaller one — because the dates were re-let at short notice, for example — and you then pay correspondingly less (see §7).

§11 Right of withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The period runs fourteen days from the day the contract was concluded.

To exercise it, inform us — Anna Radová (Dronie Munich), Agnesstraße 31, 80798 München, annaradova03@gmail.com — by a clear statement (a letter sent by post, or an email). Sending the notice before the period expires is enough to meet the deadline.

Effects. We reimburse all payments received without undue delay and no later than fourteen days after your notice reaches us, by the same means you used originally; you are charged no fee for this. If you asked for the rental to begin during the withdrawal period, you pay a proportionate amount for what was provided up to your withdrawal (§ 357a(2) BGB). The right expires on full performance under § 356(4) BGB. You give that declaration by accepting these terms during checkout.

Return. If the drone has already been handed over it must be returned without delay, whether or not you withdraw. Withdrawal ends the contract; it does not create a right to keep the item.

Model form.You may, but need not, use this wording: “I hereby withdraw from my contract for the rental of the DJI Mini 5 Pro — booking reference, name, address, date.” A plain email to annaradova03@gmail.com does just as well.

Business customers within the meaning of § 14 BGB have no right of withdrawal. For them — and for consumers once the withdrawal period has expired — the cancellation rule in §10 governs.

§12 Governing law & language

The law of the Federal Republic of Germany applies; the place of jurisdiction, where permitted, is Munich. The binding contract language is German. This English version is provided for information only; in case of discrepancy, the German version prevails.
